Public procurement
In accordance with Article 83 of the EUIPO Financial Regulation, the Office complies with the Regulation (EU, Euratom) 2018/1046 of the European Parliament and of the Council of 18 July 2018 on the financial rules applicable to the general budget of the Union, repealing Regulation (EU, Euratom) No 966/2012.
Participation in procurement procedures is open on equal terms to all natural and legal persons falling within the scope of the Treaties. This includes all legal entities registered in the EU and all natural persons having their domicile in the EU, regardless if they have branches outside EU.
Conclusion of a contract is possible only after the successful completion of a procurement procedure. The way the procurement procedure is advertised depends on the estimated maximum value of the contract to be awarded. Contracts with a value not exceeding EUR 15 000 can be awarded without any publication.
Ex-ante publicity for procurement procedures between €15,000 and €140,000
For procurement in this range the Office launches a 'negotiated procurement procedure' which depending on the value consists of an invitation to tender to at least three or five candidates. The Office publishes the planned procedure in the relevant ex ante publicity section for a minimum of two weeks to allow suppliers to express interest.

Publication of information on procurement procedures
The Financial Regulation (FR) applicable to the general budget of the European Union sets out the principles for implementation of the budget, including the principle of transparency. Article 163 of the FR and points 2 and 3 of Annex I to the FR stipulate the relevant provisions on the appropriate publication of information (particularly ex post information).
The publication arrangements are therefore as follows:
- Publication of the EUIPO intentions of planned procurement procedures by financial year;
- Publication on ex post information of procurement procedures, no later than 30 June of the following year, of:
- a list giving information on the value of and contractors for specific contracts / order forms based on a framework contract following the conclusion of a specific contract / order form or on the basis of the aggregate value of the specific contracts / order forms signed, regardless of the cumulative value of each framework contract (above EUR 15 000);
- a list of contracts worth more than EUR 15 000 awarded in accordance with points 11.1.(h) and (j) to (m) of Annex I to the FR;
- a list of contracts worth more than EUR 15 000 awarded below the thresholds laid down in Article 175(1) of the FR;
- a list of contracts worth more than EUR 15 000 awarded in the field of external actions in accordance with Chapter 3 of Annex I to the FR;
- a list of contracts modified under Article 172(3)(a) to (c) of the FR where the value of the modification is more than EUR 15 000 but below the thresholds laid down in Article 175(1).
